According to O.C.G.A. § 40-6-391(a), a person can't drive or be in control of a moving vehicle while:

Penalties of a DUI Involving Drugs

A first conviction for DUI-Drugs in ten years results in a minimum of 24 hours in jail, a fine of at least $300, 12 month probation, completion of 40 hours of community service, DUI school, a clinical drug and alcohol evaluation, and license suspension of up to six months.

A second conviction within ten years results in a minimum jail sentence of 72 hours, a fine of at least $600, 12 month probation, completion of 35 days of community service, DUI school, a clinical drug and alcohol evaluation, and license suspension of up to six months.
